Consequently, the consumer acknowledges being fully informed that their agreement to the content of these general terms and conditions does not require a handwritten signature of this document, as long as the client wishes to order online the products presented in the online shop of the website.

The consumer may save or print these general terms and conditions, noting that saving or printing this document is solely their responsibility.

The consumer, prior to placing an order, declares that the acquisition of these products is unrelated to their professional activity, as their purchase is reserved for personal use.

As a consumer, the client therefore has specific rights, which would be affected if the products or services purchased via the website were in fact related to their professional activity.

The online shop set up by Impression d’Orient on the website provides the following information:

  • Legal notices allowing precise identification of Impression d’Orient
  • Description of the essential characteristics of the goods offered
  • The price of the goods in Euros, including any applicable delivery charges
  • Terms of payment, delivery, and execution
  • The existence of a right of withdrawal
  • The validity period of the offer or price
  • Conditions for contract termination when the contract is indefinite or lasts longer than one year

All this information is presented in French. The consumer declares having full legal capacity to commit under these general terms and conditions.

Article 1: Entirety

These general terms and conditions represent the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept all the provisions of these terms without reservation. No general or specific conditions included in documents sent or provided by the consumer can be incorporated into these terms if they conflict with these terms and conditions.

Article 2: Purpose

The purpose of these general terms and conditions is to define the rights and obligations of the parties within the framework of the online sale of goods and services offered by Impression d’Orient to the consumer.

Article 3: Contractual documents

This contract is formed by the following contractual documents, listed in descending order of priority: these general terms and conditions; the purchase order. In the event of any contradiction between the provisions contained in documents of different rankings, the provisions of the higher-ranking document will prevail.

Article 4: Effective date - duration

These general terms and conditions come into force on the date of signing the purchase order. They are concluded for the time necessary to supply the goods and services subscribed to, until the expiration of the guarantees provided by Impression d’Orient.

Article 5: Electronic signature

The consumer's "double click" on the purchase order constitutes an electronic signature that, between the parties, has the same value as a handwritten signature.

Article 6: Order Confirmation

Contractual information will be confirmed via email at the latest at the time of delivery or, failing that, to the address indicated by the consumer in the order form.

Article 7: Proof of Transaction

Computerized records, stored in the information systems of Impression d’Orient under reasonable security conditions, will be considered as proof of communications, orders, and payments made between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as evidence.

Article 8: Product Information

8-a: Impression d’Orient provides on its website products for sale with necessary characteristics to comply with Article L 111-1 of the Consumer Code, allowing the potential consumer to know the essential characteristics of the products they wish to purchase before making a definitive order. Product photographs aim for high quality but cannot guarantee exact similarity with the received product, particularly regarding colors, textures, or paper. Claims on these points will not be accepted after receipt if no sample was ordered prior to full delivery.

8-b: Offers presented by Impression d’Orient are valid only while stocks last.

8-c: All products in our catalog bear our brand and cannot be sold without this mention.

Article 9: Pricing

Prices are stated in euros and are valid only on the date the order form is sent by the consumer. Delivery fees are not included and will be charged additionally, shown before the order is confirmed. Prices include VAT applicable on the day of the order, and any change in the VAT rate will automatically adjust the prices of the online shop's products. Full payment must be made when placing the order. At no time can amounts paid be considered as deposits or down payments.

Article 10: Payment Methods

To pay for their order, the consumer can choose from the payment methods listed in the order form. The consumer guarantees Impression d’Orient that they have the necessary authorizations to use the chosen payment method when validating the order form. Impression d’Orient reserves the right to suspend order management and delivery in case of payment authorization refusal by officially accredited organizations or non-payment. Impression d’Orient may refuse to process or honor an order from a consumer who has not fully or partially paid a previous order or if there is an ongoing payment dispute.

A verification procedure is in place to ensure no one uses another's bank details without consent. During this verification, the client may be required to provide a name and identification number (ID card, passport, residence permit, or driver's license) corresponding to the bank details on the back of the check. The order will only be validated after receipt and verification by our services.

If a payment instrument is not honored, various associated fees will be charged to the Client (e.g., fees for rejected direct debit or unpaid checks). Payment is required at the time of the order, initiating supply processes with our provider.

Article 11: Product Availability

Orders will be processed within a maximum of 3 days for non-customized products and within 15 days for customized products, starting from the day after the consumer places their order. In the event of product unavailability, particularly due to supplier issues, the consumer will be informed as soon as possible and given the option to cancel the order. The consumer may then choose to either request a refund within 7 days from the payment date or exchange the product.

Article 12: Delivery Terms

Products are delivered to the address provided by the consumer on the order form and only within mainland France. The consumer must check the condition of the packaging upon delivery and report any damage caused during transport to the carrier on the delivery slip, as well as to Impression d’Orient, within one week. Upon request, the consumer may receive the invoice at the billing address instead of the delivery address by selecting the appropriate option on the order form.

For shipping, we primarily use Colissimo Suivi. Once a shipment is made, you will receive an email with tracking details. Samples are sent at letter rate via standard mail.

LA POSTE

To minimize shipping costs, products of small or medium size are sent via the Colissimo Suivi postal service. This economical service delivers within 48 hours across France and offers the possibility of retrieving the package from your local post office if you are absent during delivery. If you are not present on the day of delivery, your postman will leave a notice in your mailbox, allowing you to collect your package from your local post office within 15 days during opening hours. While Colissimo Suivi is a very reliable service, delays or loss of packages may occur. In case of a delivery delay, please inform us via phone or email. We will contact La Poste to initiate an investigation, which can take up to 21 days. If the package is found within this period, it will be delivered to your address. If not, La Poste will consider the package lost, and we will send a replacement product at our expense. If the product is unavailable, we will refund the amount. If the product's price has changed, the new price will apply, and we will adjust the difference either by refund or requesting additional payment. We are not liable for extended delivery delays caused by the carrier, such as product loss or strikes.

DELIVERIES OUTSIDE MAINLAND FRANCE

Import Taxes:

Orders delivered to overseas territories or outside the European Union may be subject to local taxes, customs duties, and clearance fees, which are the consumer's responsibility. Customs duties vary based on the nature of the goods and the destination country. Please consult the relevant authorities in the delivery country for more information.

Article 13: Delivery Issues Caused by the Carrier

Any delivery anomaly (damage, missing items, damaged packaging, broken products) must be noted on the delivery slip as "written reservations" with the customer's signature. The consumer must also confirm these anomalies with the carrier by sending a registered letter with acknowledgment of receipt within two (2) business days from the delivery date. Article 14: Delivery Errors

Incorrect delivery address:

The shipment of the product(s) ordered by the customer will occur after the order is registered, fully paid, validated by our services, and prepared. The product(s) ordered by the customer will be shipped to the delivery address provided by the customer at the time of their order.

If delivery becomes impossible due to one or more errors in the customer’s entry of the delivery address, the customer will bear the cost of reshipping and will not be entitled to make any claims for delivery delays. In the case of an invalid delivery address or delivery becoming impossible due to the provision of incorrect data by the customer, the order will be returned to the warehouses of the website www.impressiondorient.com by the carrier. The customer can then request reshipment. Reshipment of the order will only take place after the customer has paid the reshipping fees.

Parcel not picked up within the given timeframe, at a pick-up point or post office:

If the parcel is returned to our premises due to the customer failing to pick it up from the destination pick-up point, the reshipping costs will be charged to the customer, who will not be entitled to claim any delivery delays.

14-a: The consumer must file any claim for delivery errors and/or non-conformity of the products in nature or quality compared to the order form, either on the day of delivery or at the latest on the first working day following the delivery. Any claim made after this deadline will be rejected.

14-b: This claim can be made to Impression d’Orient:

  • Preferably by email to the following address: impressiondorient@outlook.com, clearly stating your customer number and the reference of your order.
  • You can also call 06 18 43 43 20, Monday to Friday, from 10:00 AM to 6:00 PM.

14-c: Any claim not made according to the rules outlined above and within the required timeframes cannot be taken into account and will release Impression d’Orient from any responsibility towards the consumer.

14-d: Upon receipt of the claim, Impression d’Orient will assign an exchange number for the product(s) concerned and communicate it to the consumer by email, fax, or phone. The exchange of a product can only take place after the consumer has been assigned an exchange number, following the procedure outlined above.

14-e: In the case of a delivery error or exchange, any product to be exchanged or refunded must be returned to Impression d’Orient in its entirety, in its original packaging, by Colissimo Recommandé, to the following address:

To be accepted, all returns must be previously reported to Impression d’Orient’s Customer Service.

Article 15: Product Warranty

In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereunder cannot deprive the consumer of the legal warranty, which obliges the professional seller to guarantee the consumer against all the consequences of hidden defects of the sold item. The consumer is expressly informed that Impression d’Orient is not the manufacturer of the products presented on the website, within the meaning of Law No. 98-389 of May 19, 1998, related to the liability for defective products. As a result, in the event of damage caused to a person or property by a defect in the product, only the liability of the manufacturer of the product may be sought by the consumer, based on the information on the product’s packaging. The conditions and duration of the manufacturer's warranty are indicated on the product sheets. Given the frequency of component renewals in technical products, Impression d’Orient can, upon request, inform the consumer about the availability of spare parts for the offered products and the conditions under which they can be obtained.

Article 16: Right of Withdrawal and/or Refund

  • For items without customization (blank invitations):

The consumer has a period of 14 days to return the products they are not satisfied with, at their own expense. This period starts from the day after the consumer receives the item.

Any return must be reported in advance to Impression d’Orient’s Customer Service.

The product must be returned by Colissimo Recommandé to:

Only products returned in full, in their original, complete, and intact packaging, and in perfect resale condition will be accepted. Any product that has been damaged or whose original packaging has been deteriorated will not be refunded or exchanged.

This right of withdrawal can be exercised without penalty, except for return shipping costs. In the event of exercising the right of withdrawal, the consumer can choose between a refund of the amounts paid or an exchange of the product. In the case of an exchange, the reshipping will be at the consumer’s expense.

In the case of exercising the right of withdrawal, Impression d’Orient will make every effort to refund the consumer within 15 days. However, given the technical nature of the products sold, this period may be extended to 30 days, especially if the product requires a technical inspection (cf. products that need prior verification).

The consumer will then be refunded by a credit to their bank account (after sending a RIB) if the payment was made by credit card, or by check if this refund method is requested, which may take a little longer.

  • For personalized products (with printing):

The consumer is specifically informed that the right of withdrawal does not apply to sales of personalized products made at their request.

Article L 121-20-2 of the Consumer Code on the right of withdrawal for distance sales cannot be exercised, unless agreed otherwise between the parties, for contracts involving the supply of personalized products or products that, due to their nature, cannot be returned or are likely to deteriorate or expire rapidly.

Unprocessed Order Cancellation:

An order can be canceled free of charge within 14 days of being placed on the website. After this period, processing fees will be charged.

Exclusions:

  • Partial order completion: The creation of a proof (mock-up) results in a fixed cancellation fee of 20€, regardless of the time elapsed between the order and its cancellation.

  • No cancellations once the proof has been approved by the customer and the printing work has started. No refunds will be possible, regardless of the time elapsed since the order was placed.

Error in Proof Validation:

No claims will be accepted in the case of errors made by the customer when validating the proof (BAT = Bon à Tirer).
The validation of a proof indicates acceptance of printing your order exactly as per the approved proof and includes the following elements:

  • Text
  • Spelling
  • Layout
  • Color matching

We emphasize the importance of this step in your order process.

Article 17: Usage Rights

The right to use the software from Impression d'Orient, as well as those distributed by it, is granted to the consumer on a non-exclusive, personal, and non-transferable basis, in accordance with the French Intellectual Property Code. However, under Article L122-6-1 of this Code, the consumer has the right to reproduce the software solely for the creation of a backup copy, when such a copy is necessary to preserve the use of the software. In any case, the author of the software retains ownership rights over their work, which the consumer agrees to respect.

Article 18: Force Majeure

Neither party shall be considered in breach of its contractual obligations if their performance is delayed, hindered, or prevented by an unforeseeable event or force majeure. An event or force majeure is defined as any irresistible circumstance, external to the parties, unforeseeable, unavoidable, independent of the parties' will, and that cannot be prevented despite all reasonable efforts. The affected party shall notify the other party within ten working days from the date it becomes aware of such circumstances. Both parties shall then meet within one month, unless an impossibility arises due to the force majeure event, to assess the impact of the event and agree on the conditions under which the contract will continue. If the force majeure event lasts more than three months, the affected party may terminate the present terms and conditions. Expressly, the following are considered as force majeure events or unforeseeable events, in addition to those usually recognized by the jurisprudence of French courts: transport or supply blockages, earthquakes, fires, storms, floods, lightning, telecommunication network outages, or difficulties related to external telecommunication networks not under the control of the clients.

Article 19: Partial Invalidity

If one or more provisions of these terms and conditions are deemed invalid or declared so by law, regulation, or a final decision from a competent court, the remaining provisions shall retain their full force and effect.

Article 20: No Waiver

The failure of either party to invoke a breach by the other party of any of the obligations outlined in these terms and conditions shall not be interpreted as a waiver of the obligation in question for the future.

Article 21: Headings

In case of any difficulty in interpretation between one of the headings at the beginning of the clauses and one of the clauses themselves, the headings shall be deemed non-existent.

Article 22: Governing Law

These terms and conditions are governed by French law. This applies to both substantive and procedural rules. In the event of a dispute or claim, the consumer should first contact Impression d’Orient to seek an amicable solution. If necessary, and in the case of legal recourse, the consumer may submit a claim via the dedicated dialogue box.

Article 23: Data Protection

The information requested from the consumer is necessary for the processing of their order and may be communicated to the contractual partners of Impression d’Orient involved in the execution of this order. The consumer can write to Impression d’Orient, using the contact details in the privacy policy available on the website, to object to such communication or to exercise their rights of access and rectification concerning the data about them held in the files of Impression d’Orient, in accordance with the provisions of the French Data Protection Act of January 6, 1978.
